i believe it says that the patch will flick to a 'legacy mode' is playing someone with an older version so that it will play like the older one for compatibility.

thats why you shouldnt be able to play with the "non-patched" people so if enough people have the patch the others will be forced to get the patch, because there will be no one to play with if they don't have the patch coz they can't play with the patched people.

When someone without the latest patch joins your game, their name will be highlighted and you'll have the option of playing with bugs or booting them. Not a tough choice really.

one advantage to backwards-compatibility would be that you could join beta2 hosts if you can't host for some reason.
